Chapter 72: PLANNING BOARD

ARTICLE I Organization
72-1. Establishment; membership; Chairman.
A Planning Board consisting of five members is hereby established. The Board of Trustees shall appoint the members of said Board, one of whom shall be either an architect or an engineer, and shall have authority to remove any member for cause and after public hearing. The Board of Trustees shall designate one of the members so appointed as Chairman of said Board.
72-2. Terms of office.
The members of the existing Planning Board in office at the time this chapter takes effect shall continue in office until the end of the term for which they were appointed. Their successors shall be appointed for terms of five years; provided, however, that the members first appointed as successors to members of the existing Planning Board who are officials of the village and who were appointed as such members because of being officials of the village shall be appointed for terms of such periods of years, not more than five, as shall integrate with the terms of successors to other members of such Board in such manner that after the expiration of the terms of office of members now in office the term of one member of the Board shall expire each year.
72-3. Vacancies.
If a vacancy shall occur otherwise than by expiration of term, it shall be filled by appointment for the unexpired term.
72-4. Village officials as members.
Any officials of the village on the Planning Board shall not, by reason of membership thereon, forfeit their right to exercise the powers, perform the duties or receive the compensation of the municipal office held by them during such membership.
ARTICLE II Powers
72-5. Expenditures.
The Planning Board shall have the power and authority to employ experts, clerks and a secretary and to pay for their services and such other expenses as may be necessary and proper, not exceeding in all the appropriation that may be provided for such purposes by the Board of Trustees.
72-6. Rules and regulations.
The Planning Board may adopt rules and regulations in respect to procedure before it and in respect to any subject matter over which it has jurisdiction, after public hearing by the Planning Board and subject to the approval of the Board of Trustees.
72-7. Master plan. Editor's Note: Amended at time of adoption of Code (see Ch. 1, General Provisions, Art. I).
The Planning Board may prepare and change a comprehensive master plan for the development of the entire area of the village in accordance with 7-722 of the Village Law of the State of New York.
72-8. Changes to Official Map.

A. |
Before making any change or addition to the Official Map of the village, the Board of Trustees shall refer the matter to the Planning Board for report thereon. If the Planning Board shall not make its report within 30 days of such reference, it shall forfeit the right further to suspend action by the Board of Trustees. |

The Board of Trustees shall give notice of any hearing scheduled to amend the Official Map affecting streets connecting directly into any state or county highway, parkway, thruway or road or affecting drainage lines connecting directly into channel lines established by the Westchester County Commissioner of Public Works by mailing a copy thereof at least 10 days prior to such hearing to the Westchester County Planning Board in accordance with 277.61 of the Westchester County Administrative Code. The Westchester County Planning Board may appear at any such hearing and be heard and file a memorandum of its position. If the County Planning Board disapproves the proposal on which the hearing is held or recommends changes or modifications thereof, the Board of Trustees shall not act contrary to such disapproval or recommendation except by the adoption of a resolution, which action shall be subject to judicial review pursuant to the laws providing for the review of acts of such Board commenced within 30 days of its adoption. The Board of Trustees shall give notice of any hearing scheduled to amend the Official Map relating to any land within 500 feet of any abutting municipality by mailing a copy thereof at least 10 days prior to such hearing to the Clerk of said abutting municipality in accordance with 277.71 of the Westchester County Administrative Code. Such abutting municipality may appear and be heard at such hearing and may file thereat a memorandum of its position. If such abutting municipality disapproves the proposal on which the hearing is held or recommends changes or modifications thereof, the Board of Trustees shall not act contrary to such disapproval or recommendation except by the adoption of a resolution, which action shall be subject to judicial review pursuant to the law providing for review of acts of such Board. 72-9. Referrals.
The Board of Trustees may by general or special rule provide for the reference of any matter or class of matters to the Planning Board before final action by the public body or officer of the village having final authority thereon with or without the provision that final action shall not be taken until said Planning Board has submitted its report or has had a reasonable time, to be fixed by the Board of Trustees in said rule, to submit the report.
72-10. Subdivision approvals.
The Planning Board shall have such power and authority to approve subdivisions as may be delegated to it by the Board of Trustees pursuant to the provisions of Chapter 268 of this Code.
72-11. Prerequisites to issuance of building permits.
No permit for the erection of any building shall be issued unless a street or highway giving access to such proposed structure has been duly placed on the Official Map and such street or highway shall have been suitably improved to the satisfaction of the Planning Board in accordance with standards and specifications approved by the appropriate village officers as adequate in respect to the public health, safety and general welfare for the special circumstances of the particular street or highway, or, alternatively, and in the discretion of such Board, a performance bond sufficient to cover the full cost of such improvement as estimated by such Board or other appropriate village departments designated by such Board shall be furnished to the village by the owner.
